Definitions

a) “Crushed Raspberry Designs" means , also referred to as “we” or “us” in these terms and conditions.

b) “Force majeure” means any clause affecting the performance by Crushed Raspberry Designs of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.

c) “Working days” means Monday to Friday, excluding Bank or other public holidays.

To make a purchase on the Website, you need to:

2. Orders

a) All contracts of sale made by Crushed Raspberry Designs shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the party (“the customer” ) with whom Crushed Raspberry Designs is dealing. Cancellation of orders by business to business customers is not accepted as many orders are despatched on the same day the order is placed. Cancellation of orders by consumers can only be accepted in accordance with the Consumer Contracts Regulations 2014.

b) All orders are subject to acceptance and to availability of the goods ordered. Crushed Raspberry Designs is entitled to refuse any order placed by you.

c) You undertake that: 1. all details you provide to us for the purpose of purchasing goods or services offered on our website are correct and 2. the credit or debit card you use to make a purchase from us is your own or your company’s card, that you are authorised to use it, and that there are sufficient funds or credit facilities to cover the cost of any goods or services you order from us. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services.

3. How to Place an Order

a) You can place an order via our website www.crushedraspberrydesigns.com following the prompts given or by calling us on 07790 575537

b) Once you have placed an order you will be contacted via e-mail within 24hrs (or next working day) with details of your order and further information. Please ensure you check the details are correct and contact us at your earliest convenience if anything is incorrect or not as expected.

c) The successful placement of your order is deemed your acceptance of these terms & conditions. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. In the unlikely event that we are unable to accept your order, we will notify you as soon as possible. Non-acceptance of an order may be as a result of one of the following:

i) the product you ordered being unavailable from stock;

ii) a product pricing or description error;

iii) our inability to obtain authorisation for your payment; or

iv) we are unable to meet a delivery deadline you have specified.

d) Once you have set up your account with us as part of the order process, you will be able to access your order details from our website.

4. Prices & Payment

All prices for products on the Website include any applicable VAT at the applicable current rate chargeable in the UK for the time being. Prices for products may change from time to time, but changes will not affect any order you have already placed.

 

Products on the Website can only be delivered to Mainland UK addresses.

Payments for all products must be paid in Pound Sterling and can be paid for via our third party payment provider,  at checkout. Payment will be taken when you submit your order and you will then receive an email order confirmation.

a) All prices are inclusive of VAT at the current rates where applicable and are correct at the time of entering information.

b) Crushed Raspberry Designs reserves the right to change prices without prior notice.​

c) Payment can be made by any major credit or debit card. Payment will be debited and cleared from your account before the despatch of your good(s) or provision of service to you.

d) You confirm that the credit/debit card that is being used is yours

e) All credit/debit card holders are subject to validation checks and authorisation by the card issuer and we may share your personal information with such parties as are necessary to enable us to do such checks. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

f) All prices and charges on our website are quoted in Pounds Sterling. All product prices include VAT, but exclude any delivery costs. These are calculated as part of the checkout process, based on the delivery service chosen, the delivery location and the size or weight of your products. We take all reasonable care to ensure that the price of the products advised to you is correct. If we discover an error in the price of products you have ordered we will inform you as soon as possible and give you an option of reconfirming your order at the correct price, or cancelling the order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

g) If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

h) Payment for your order is made at the point of placing the order. For website orders please see our Payment Options page for a full list of payment options. For telephone orders we accept payment with most types of credit and debit card (Visa, Mastercard or Maestro).

i) We will advise you if your payment details cannot be authorised for any reason or if your cheque has failed to clear. We will then arrange for payment to be made by another method.

j) You own a product once it has been delivered and we have received payment in full.

5. Delivery, Title and Risk

a) Any time or date stated for delivery is an estimate only. Crushed Raspberry Designs makes every effort to despatch goods on time, but does not accept liability for failure to deliver within the stated time.

b) If Crushed Raspberry Designs is unable to deliver the goods within 30 days of the date of order, the Customer will, as its sole remedy, be entitled to cancel the order and require any monies paid to Crushed Raspberry Designs in respect of that order to be refunded. In order to cancel, the Customer must send written notice of cancellation to Crushed Raspberry Designs after the above date, but before delivery of the goods or notification from Crushed Raspberry Designs that the goods are ready for delivery.

c) Crushed Raspberry Designs does not accept liability for shortages or damage to deliveries unless the Customer notifies Crushed Raspberry Designs of the shortage or damage in writing within 7 days of receipt of the delivery.

d) The customer has to accept the goods when they are ready for delivery.

e) Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risk of loss, breakage and all damage and all other risks shall pass to the Customer.

f) Title in the goods does not pass to the Customer until payment is received in full by Crushed Raspberry Designs.

g) We will deliver your products to the address you provide us at the time you place your order.

h) We can only deliver within the UK mainland. Also note in the event you arrange for our products to be taken outside of the UK mainland we will only be able to organise exchanges/returns from UK mainland addresses, therefore we recommend your order is checked prior to onward shipping. It is also important that your goods are checked at this point, as we will not accept liability for damage caused by your third party carrier - We normally deliver within 3-5 working days, however some locations at the furthest corners of the Country can take longer and depends on the service Royal Mail is providing at any given time. Please contact us if you require further clarification.

​i) If a product is unavailable from stock or our supply of the products is delayed by an event outside our control (i.e. a delay from our suppliers or adverse weather conditions) then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received. In the event that you do not choose to end the contract in these circumstances, we reserve the right to cancel the contract and we will write to you to inform you of this and will refund you in full for any money you have paid in advance for the product.

k) Products will be your responsibility from the time of delivery of them to the address you gave us.

6.  Product Specifications

a) Crushed Raspberry Designs makes every effort to supply the goods as advertised but reserves the right to supply the goods subject to minor variations in actual dimensions, specifications and, in the case of bulk items, quantities without prior notice.

​

b) If Crushed Raspberry Designs cannot supply the goods ordered by the Customer, Crushed Raspberry Designs reserves the right to offer goods of equal or superior quality at no extra cost. In such a case, if the Customer does not wish to accept the alternative goods offered, he or she may cancel the order and require the refund of any money paid to Crushed Raspberry Designs in respect of that order. This shall be the sole remedy of the Customer in these circumstances.

7. Our Products

a) Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. We endeavour to display as accurately as possible the colours of our products on our website, however, as different computers display colour tones differently we cannot guarantee the complete accuracy of the pictures or photographs that are shown.

b) Any products identified as 'End of Line' in the product description are discontinued items of which we will not get any more stock. This means that we will be unable to source parts or exchange this product for a new equivalent in the event of a problem. This is reflected in the price of the products. All products are new and sold as new. This status and discount does not affect your statutory right to a refund in event of dissatisfaction. Please refer to our refunds policy within our Terms which applies to all products sold.

c) If you wish to make a change to the product you have ordered, following order but before despatch, please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing for delivery or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

8. Errors and Omissions

a) Crushed Raspberry Designs makes every effort to ensure that all prices and descriptions quoted on its website are correct and accurate. However, the fast-moving nature of e-commerce makes it inevitable that mistakes will occasionally occur. In the case of a manifest error or omission, Crushed Raspberry Designs will be entitled to rescind the contract, notwithstanding that it has already accepted the Customer’s order and/or received payment from the Customer. Crushed Raspberry Designs liability in that event will be limited to the return of any money the Customer has paid in respect of the order. In the case of a manifest error in relation to price, the Customer will be entitled to purchase the goods by paying the difference between the quoted price and the correct price, as confirmed in writing by Crushed Raspberry Designs after the manifest error has been discovered.

b) A ‘manifest error’, as the term is used in paragraph above, means, in relation to an incorrect price, a price quoted in error by Crushed Raspberry Designs which is more than 10% less than the price that would have been quoted had the mistake not been made.

9. Warranties and Returns:

Due to items being made to order, we do not offer returns or refunds on products.

a) Crushed Raspberry Designs is committed to providing our customers with the highest quality products and service. However, on rare occasions, products may be found to be faulty or defective. In such cases, we offer the returns facilities described below.

​

b) All goods supplied by Crushed Raspberry Designs are deemed to be generally free from defects in workmanship and materials and fit for the purpose for which such goods would normally be used. If you purchase goods in the course of your business, all other express or implied terms or warranties relating to the goods are excluded to the fullest extent permitted by law. Subject to this, however, goods are not tested or sold as being fit for any particular or for use under specific conditions, unless expressly agreed in writing. All services provided by Crushed Raspberry Designs will be provided with reasonable skill and care and within a reasonable period. If you purchase services in the course of your business, all other express or implied terms or warranties relating to the services are excluded to the fullest extent permitted by law.

c) Subject to the right of consumers to return goods for refund under The Consumer Protection (Distance Selling) Regulations 2000 Crushed Raspberry Designs does not sell products on a trial basis. Customers are strongly advised to check suitability and specifications of products before ordering.

d) In the event that Crushed Raspberry Designs, at its discretion (unless the Consumer Contracts Regulations apply), agrees to accept the return for credit of unwanted products, the goods must be returned within the guidelines of the Returns Policy.

We ask that any returns comply with the requirements listed below, so please make sure you read this through before beginning the returns process.

Which items cannot be returned?
Any items that have been personalised for you or that have been made to your specification, such as where the products are tailor-made or you have requested that they contain a name or initials, cannot be returned, so please do check all personalisation and customisation carefully before you make a purchase - - We currently do not accept personalisation of items at this moment in time, but we will be in the future.

Damages and issues

Please inspect your order and contact us straight away if the item is defective, damaged or if you receive the wrong item. As proof of damage, photographs will need to be taken at the time of receipt of the goods and email sent to hello@crushedraspberrydesigns.com explaining the issue, along with photographs. 

Preparing Your Return:
If a return for a product has been agreed, all items must be returned in the original packaging provided.
Fragile items (such as glassware, ceramics, rolled artwork or paper creations) must be repackaged exactly as they arrived, and wrapped carefully in the protective packaging they came with originally.
Where provided, any packaging such as dust bags and clothing tags should be included with your return.
The item(s) should be returned unused, unworn and in perfect condition. Any returns that are damaged, soiled or returned without their original packaging might not be accepted and may be sent back to you.

10. Crushed Raspberry Designs' Liability:

a) Crushed Raspberry Designs shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, (including (but not restricted to) loss of business or profits, loss of goodwill, damage to trading relationships, loss of data and other financial loss. (“Financial loss” in this sense does not refer to the price you have paid for the goods, which we may be liable to refund to you, in whole or in part, if the goods are faulty or do not comply with their description). Crushed Raspberry Designs liability in respect of all other losses shall be limited to the invoiced amount of the relevant order, provided it has been paid.

b) Nothing in this agreement shall limit Crushed Raspberry Designs' liability for death or personal injury caused by its negligence.
 

11. Promotional Offers

On occasion Crushed Raspberry Designs chooses to run promotions and offers on selected products or lines. Qualifying promotions and offers will be automatically applied to your order both on the website and in-store and are subject to the below terms and conditions:

• With the exception of free delivery offers, promotions cannot be used in conjunction with any other offers

•Offers are valid only on the full-price products indicated

•Offers are valid for limited-time periods except clearance sale items

•Gift Cards are exempt from all offers

•If an item is returned for a refund that brings the amount spent below any qualifying amount, the refund may be reduced to reflect this

•All offers are subject to stock availability. Crushed Raspberry Designs reserves the right to amend, withdraw or extend offers at any time, without prior notice.

12. Health and Safety

a) In accordance with the Health and Safety at Work, etc Act 1974 and the Consumer Protection Act 1987, Crushed Raspberry Designs confirms that the goods it supplies as a distributor do not present a hazard to health and safety (1) when properly used for the purpose for which they are designed, and (2) if the Customer takes reasonable and normal precautions in their use.

13. Force Majeure

a) Where, in spite of its reasonable efforts, Crushed Raspberry Designs is unable to perform an obligation due to force majeure, it shall not be deemed to be in breach of its contract with the Customer.

14. The Consumer Contracts Regulations 2014

a) Contracts for the purchase of goods by a customer not acting in the course of a business and made over the telephone or through the Crushed Raspberry Designs website, or by mail order, are, with the exception of certain excepted contracts, subject to The Consumer Contracts Regulations 2014 (“the Regulations”).

b) If the Regulations apply, Customers may cancel goods purchased from Crushed Raspberry Designs by sending a written notice of cancellation by post addressed to Crushed Raspberry Designs, c/o 114 Bath Road, Cheltenham, Gloucestershire, GL53 7JX or call; 07790 575537 or by e-mail; hello@crushedraspberrydesigns.com

c) The notice of cancellation must be sent within 14 working days of the date of delivery after the goods are received.

​

d) The Customer will be responsible for the cost of returning the goods if they exercise this right of cancellation under the Regulations. If the Customer does not actually return the goods to Crushed Raspberry Designs the Customer is under a duty to make the goods available for collection at the Customer’s expense from the address to which they were delivered.

e) The Customer is under a duty to retain possession of the goods whilst awaiting return to Crushed Raspberry Designs and to take reasonable care of them during this period. The Customer will be liable for any loss of or damage to the goods if they fail to comply with this obligation.

15. General

a) Nothing in these terms and conditions affects your statutory rights as a consumer.

b) If any provision in this agreement is held to be invalid or unenforceable, it shall be deemed severed from the Agreement and this shall not affect the validity or enforceability of the remaining provisions.

c) Any waiver of a breach of this Agreement must be in writing.

​

d) Any variation of this Agreement must be in writing and signed by a duly authorised Crushed Raspberry Designs official.

e) The headings are for convenience only and shall not affect the interpretation of these terms and conditions.

​

f) Any notices given under these terms and conditions shall be in writing and sent: (1) by first class pre-paid post to the last known address of the party, or (2) by e-mail to the last notified e-mail address of the party.

​

g) The notice shall be deemed served: (1) two working days after posting, or (2) after system confirmation of e-mail delivery.

​

h) These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

​

i) Crushed Raspberry Designs may, at its discretion, record telephone transactions for staff training and quality control purposes.

​

j) Crushed Raspberry Designs reserves the right to change or amend these terms and conditions at any time and without prior notice.

17. Right to Change your Mind

a) Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most products bought online you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013.

18. Privacy

a) We understand that you care how information about you is used and shared and we appreciate your trust in us to deal with it sensibly.

b) We will only use your personal information as set out in our Privacy Policy.

19. Customer Surveys & Reviews

a) After your order has been completed we may contact you with a short customer survey. We would be very grateful if you could complete it as it will help us to continue to improve our customer service. Some sections of these surveys will be posted on our website using your name and location (i.e. initial, surname, county). If you would prefer that your comments aren't used in this manner please let us know.

b) After your order has been delivered, we may contact you to ask you to leave a review of the product(s) you have ordered. Submitted reviews will automatically appear on the relevant product page but we reserve the right to alter or remove reviews in the following cases:

i) The review is not relevant to the actual product itself, i.e. applies to the service you received from Crushed Raspberry Designs

ii) The review contains language that could be considered offensive to other users.

iii) The review contains spelling errors or grammatical mistakes that affect the readability of the review and presentation of the page. Please note that in this case, the review will normally be amended, as long as it doesn't conflict with the first two conditions.
